Genius by PettySave App. is a financial management software deployed to businesses and individuals providing them with a credit solution to help fund that cashless dreams with no collateral while making smart spending decisions and getting rewards for any money spent, having, ensuring purchase protection and emergency funding as well as building your credit history Before you engage with our website, app, or services, we encourage you to read these Terms of Service, so you know what to expect when visiting and engaging with our various services.
PLEASE READ THESE TERMS OF SERVICE ("AGREEMENT") CAREFULLY. THIS AGREEMENT IS A LEGAL CONTRACT BETWEEN YOU ("USER") AND PETTYSAVE MICRO FINANCE BANK LIMITED OR THE APPLICABLE AFFILIATE OF PETTYSAVE MICRO FINANCE BANK LTD DOING BUSINESS AS “GENIUS BY PETTYSAVE ("COMPANY," "WE," OR "US").
By accessing or using any website with an authorized link to this Agreement (each a "Website"), accessing or using any application with an authorized link to this Agreement (“App,” together with the Websites, the “Properties”), registering an account, or accessing or using any product, information, services available or enabled via this app or clicking on a button or taking another action to signify your acceptance of this Agreement, you: (1) agree to be bound by this Agreement and any future amendments and additions to this
Agreement as published through the Services; (2) represent you are of legal age to form a binding contract; and (3) represent that you have the authority to enter into this Agreement personally and, if applicable, on behalf of any company, organization or other legal entity on whose behalf you use the Services. Except as otherwise provided herein, if you do not agree to be bound by this Agreement you may not access or use the Services.
Your use of the Services is also subject to any additional terms, terms of use, conditions and policies that we separately post on the Services ("Supplemental Terms") which are incorporated by reference into this Agreement. Some of the specialized features accessible through our Services are provided by third-party companies pursuant to their own separate terms of service (“Third-Party Terms”) that differ from ours. By using such third-party features and tools, you agree that your relationships with the third- party service providers will be governed by the applicable Third-Party Terms.
We reserve the right to modify this Agreement or its policies relating to the Services at any time, effective upon posting of an updated version of this Agreement or any applicable Supplemental Terms on the applicable Services. You should regularly review this Agreement. Your continued use of the Services after any such changes constitutes your agreement to such changes.
2. Definitions of key words
Account – This is the payment account used for effecting payment transactions in line with this Agreement, which is provided and sustained in your name.
Account Balance – This is the net amount of money available for your use at a specific time.
Agreement – This is the agreement entered into between you and us upon your registration as a user on the Platform and the acceptance of your registration, subject to these Terms & Conditions.
Authentication – The process of verifying your identity when accessing the Platform or initiating a transaction, typically using PINs, passwords, OTPs, biometrics, or security questions.
Available Credit – The portion of your approved Credit Limit that is still accessible for withdrawal or transaction use at a given time.
Borrower – A User who has received or applied for credit or a loan through the Platform.
Business Day – Any day except Saturday, Sunday and any statutory holiday in Nigeria or any day on which banking institutions in Nigeria are required by law or other governmental action to close.
BVN (Bank Verification Number) – A unique identification number issued by the Central Bank of Nigeria and linked to a User’s biometric data, used for verifying identity.
Card – The reloadable credit card issued to users, subject to Terms & Conditions of the card issuer.
Card Fees – All fees due to the Card issuer, deductible from accounts and related to transactions carried out on the Card.
Cash Advance – A withdrawal of funds made using your available credit, typically subject to interest and/or fees.
Charges – All sums payable to Us by You with respect to our services and inclusive of the Card Fees. Confidential Information – Any non-public information disclosed by either party (including technical, business, financial, or personal data) that is marked or reasonably understood to be confidential. Credit – A sum of money made available to You by Us (or a lending partner), under agreed terms, for repayment with or without interest.
Credit Agreement – A supplementary agreement detailing the terms and obligations related to the provision of a specific Credit Facility.
Credit Assessment – The process of evaluating your creditworthiness, based on personal information, financial behavior, transaction history, or other risk indicators.
Credit Facility – A loan or line of credit extended to You by Us or our lending partners, governed by separate loan terms and repayment conditions.
Credit Limit – The maximum amount of credit approved for You to access or draw from under a Credit Facility. Credit Report – A summary of your credit activity, repayment history, and creditworthiness as compiled by Us or a third-party credit bureau.
Credit Score – A numerical representation of your creditworthiness generated through proprietary algorithms or obtained from licensed credit bureaus.
Disbursement – The transfer of approved funds (credit or loan) into your designated Account.
Dispute – Any disagreement, claim, or controversy between You and Us arising out of or relating to this Agreement, the use of the Platform, or any Service offered.
Due Date – The specific date by which a repayment or installment under a Credit Facility must be made to avoid penalties or interest.
Electronic Communication – Any communication sent electronically including via email, SMS, in-app notification, or through the Platform.
Fines – All fines, fees, penalties, or other charges imposed by a financial institution partner or regulatory authority arising from your breach or violation of this Platform Agreement, any Card Terms, any other agreements you have with Genius by PettySave or a financial institution partner, any law or any regulation. Force Majeure – Any event or circumstance beyond Our reasonable control that prevents or delays Us from fulfilling Our obligations under this Agreement, including but not limited to natural disasters, power failures, internet outages, acts of war, or government actions.
Installment – A scheduled payment amount due from You at regular intervals, as part of a repayment plan under a Credit Facility.
Intellectual Property Rights – Includes rights inherent in patents, copyrights, trademarks, trade secrets, design models or other intangible property rights and applications to the ends of such rights which may be currently or in the future sought for.
Interest – The cost of borrowing money, expressed as a percentage rate applied to the outstanding balance over time.
KYC (Know Your Customer) – The process of verifying the identity of Users in compliance with applicable anti-money laundering and financial regulations.
Loan Tenure – The agreed period over which a Credit Facility must be repaid, including all installments and charges.
Merchant – A business or entity that accepts payments through the Platform or offers products/services that can be paid for using Our Services.
Mobile Wallet – A digital account linked to your Account or Card that allows you to store, send, and receive funds electronically using a mobile device.
Outstanding Balance – The total amount You currently owe under a Credit Facility, including principal, interest, and any applicable charges.
Overdue Payment – Any payment that has not been made by the specified Due Date and remains unpaid. Personal Information – Information of You which includes company name, address, registration number and any such information that can identify, portray, or be reasonably linked to You or confirms your identity. PIN (Personal Identification Number) – A secret numeric code set by the User, used to authorize transactions and access secured features of the Platform.
Platform – The User Interface of Our website and mobile application.
Platform Content – All information, graphics, text, software, code, and other materials made available through the Platform, including proprietary tools, user interfaces, and data displays.
Privacy Policy – The statement that outlines how We collect, use, share, and protect Your Personal Information, forming part of this Agreement.
Regulatory Authority – Any agency, department, or body responsible for supervising financial services and compliance in Nigeria or other applicable jurisdictions.
Repayment Schedule – A breakdown of the total repayment plan showing due dates, installment amounts, interest, and outstanding balances.
Security Breach – Any unauthorized access to or disclosure of User data, the Account, the Platform, or any component of the Services.
Services – Access to the Platform by You, payment services that You intend to procure, and customer support services offered to You by Us.
Suspension – Temporary disabling of your access to the Platform or Services due to suspected fraud, regulatory non-compliance, or violation of this Agreement.
Taxpayer Identification Number (TIN) – A unique identifier issued by the relevant tax authority used for tracking tax obligations.
Third-Party Service Provider – Any third party contracted by Us to perform functions related to the Platform or Services, including payment processors, banks, or verification partners.
Top-Up – An increase in your current Credit Facility, either through an additional disbursement or adjustment to your Credit Limit.
Transaction Data – Any information resulting from the processing of a transaction.
Unauthorized Transaction – A payment or transfer made without your consent or authority and not initiated by You or someone authorized by You.
User – Any individual or organization that registers an Account on the Platform in order to access the Services.
Wallet – A digital account feature on the Platform used to store and manage funds, including credit disbursements, repayments, and incentives.
Withdrawal – The process of moving funds from the Wallet or Platform to your linked Bank Account or Card
Introduction
These Terms and Conditions ("Terms") govern the use of the Genius by PettySave ("Credit Card"), issued by PettySave Microfinance Bank Ltd. ("we", "us", or "our"). By using this Credit Card, you ("you", "your", or "the customer") agree to be bound by these Terms.
Eligibility
To be eligible for a Genius Credit Card, the applicant must:
Be at least 18 years of age.
Have a valid and active PettySave Microfinance Bank account.
Meet our creditworthiness and KYC (Know Your Customer) requirements.
Credit Limit
Your credit limit will be determined by us at our sole discretion based on your credit profile and transaction history. You will be informed of your available credit limit at the time of card issuance and via your Genius app.
Interest-Free Repayment Period
You are eligible for an interest-free repayment period of 30 calendar days from the date of each credit transaction. If you repay the full credit amount within 30 days, no interest will be charged. If full repayment is not made within 30 days, interest will apply as may be provided.
Interest on Outstanding Balances
If repayment is not made in full within the 30-day interest-free period:
Interest will be charged on the outstanding balance at a daily rate, or such rate as may be notified from time to time. Interest will accrue daily and be compounded monthly until the outstanding amount is fully repaid.
Minimum Payment
You are required to make at least the minimum monthly payment, which will be specified in your monthly statement. Failure to do so may result in additional fees and impact your credit standing.
Fees and Charges
All Card fees will be charged directly to the Card which incurred the charge and automatically deducted from the Card linked to an account in accordance with the Card terms and conditions. Card fees may be reviewed at intervals in accordance with the Card terms and conditions.
We will notify you in advance of any other fee not expressly stated which Disclosure may be provided by notice or through an addendum to these Terms & Conditions. Where there is a shortfall, you agree that any Card fees applied to the Card shall be reimbursed by you immediately on demand. You further agree that we may at our sole discretion use available funds on your link account to cover any outstanding shortfall on your Card.
Applicable fees may include (but are not limited to):
Late Payment Fee: if payment is not received by the due date. Card Replacement Fee: in case of loss or damage.
All applicable fees will be disclosed in your Genius app and updated from time to time.
Use of Card
You may use the card for purchases or transactions within the approved limit. Unauthorized or fraudulent use is strictly prohibited. You must notify us immediately if your card is lost, stolen, or compromised.
Account Suspension or Termination
We reserve the right to suspend or terminate your Credit Card account if: You default on your repayment obligations.
You breach any of the Terms outlined herein.
Your account activity is deemed suspicious or fraudulent.
Communication
We may send all notices, disclosures, and account-related communication via your registered email address, SMS, Push notifications via the Genius app. It is your responsibility to keep your contact information up to date.
If you change any information provided to us at registration, you agree to notify us within seven (7) days of such change. We may not respond to you if you contact us from an address, telephone number or email account not registered with us.
Amendment of Terms
We may revise these Terms at any time by posting the updated version via the Genius app or other official channels. Continued use of the Credit Card after changes are made will constitute your acceptance of the revised Terms.
Registration; Other Services
When applying for or registering an account for any of the Services offered by Genius by PettySave including, but not limited to, subscribing or gaining access to other services, you agree to provide accurate, current and complete information (the "Registration Data") and to promptly update your Registration Data in the event of a change of such Registration Data, including, but not limited to, name change, credit, debit card or payment account information, e-mail address or postal address, as necessary. You agree that you may not register for an Account if you are barred or otherwise suspended from using the Services under any applicable law or by the Company. You further agree that you will not maintain more than one Account for the same Company service at any given time. You will be responsible for all activities that occur under your Account. You agree not to share your Account or password
with anyone. You further agree to notify the Company immediately of any unauthorized use of your password or any other breach of the security of your Account.
13 Third Party
Certain portions of the Services may provide you the opportunity to be contacted by third party suppliers and others in order to obtain particular services. By providing your contact information in connection with these Services, you understand and expressly consent to be contacted by these third parties using the contact information you provide and that we shall have no responsibility or liability whatsoever in connection with any product or the provision of services by these third parties
Consent to Electronic Signature and Communications
You agree that submitting your application for Genius by PettySave account, and indicating your agreement to the Terms & Conditions electronically during the application process constitutes your electronic signature to the terms and conditions. You also agree that your electronic consent has and will have the same legal effect as a physical signature. By agreeing to the Terms & Conditions, you consent to us providing Notices and account statements to you electronically and understand that this consent has the same legal effect as a physical signature.
Representations and Warranties You represent and warrant that:
You are at least 18 years of age and legally capable of entering into binding contracts.
All information you provide during application and use of the credit card is true, complete, and accurate.
You are not impersonating any person or entity and are not violating any applicable law by using this service.
You will use the credit card solely for lawful and personal purposes and not on behalf of any third party without prior written authorization.
Privacy Notice
We are committed to protecting your personal data in accordance with the Nigeria Data Protection Regulation (NDPR).
We collect, process, and store personal data necessary to provide our services, including identity verification, credit scoring, and transaction monitoring.
Your information may be shared with third parties (e.g., credit bureaus, regulatory bodies) as required by law or with your consent.

Account Security
You are responsible for maintaining the confidentiality of your login credentials, PINs, and any device used to access your account. Notify us immediately if you suspect any unauthorized access or breach. We are not liable for losses resulting from your failure to secure your account or device.
Unacceptable Use
You agree not to use the credit card for:
Any illegal or fraudulent transactions. Purchases of prohibited goods or services, including but not limited to narcotics, unlicensed firearms, or human trafficking, transactions that may damage, disable, overburden, or impair our systems. violations of any applicable law or regulation.
Intellectual Property
All content, technology, software, and trademarks related to the Genius by PettySave services are the exclusive property of PettySave Microfinance Bank or its licensors.
You may not reproduce, modify, distribute, or use any part of the service for commercial purposes without prior written consent.
Taxation
You are solely responsible for the payment of any taxes, levies, or duties arising from the use of the credit card, as required by Nigerian tax laws. We may report transactions and balances to the Federal Inland Revenue Service (FIRS) as mandated by law.
Disclaimer
The credit card service is provided “as is” and “as available.”
We make no warranties, express or implied, regarding the availability, reliability, or suitability of the service for your specific needs. We do not guarantee uninterrupted or error-free operations.
Limitation of Liability
To the maximum extent permitted by law, Genius by PettySave and PettySave Microfinance Bank Ltd. shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to the use or inability to use the credit card. In no event shall our total liability exceed the amount of fees paid by you for the use of the credit card in the 3 months preceding the claim.
Indemnity
You agree to indemnify, defend, and hold harmless PettySave Microfinance Bank, its affiliates, officers, and employees from any claims, liabilities, damages, losses, and expenses arising from:
Your use of the credit card.
Your violation of these Terms or any applicable law.
Your infringement of third-party rights, including intellectual property or data privacy rights.
Termination
We reserve the right to suspend or terminate your credit card and related services at any time with or without notice, including but not limited to cases of suspected fraud, default, or regulatory violation. You may also close your account by notifying us in writing, provided all outstanding dues have been settled.
Updates, Modifications, and Amendments
These Terms may be updated from time to time to reflect changes in law, technology, or business practices. We will notify you of significant changes via the Genius App or registered email. Your continued use of the credit card after such notice constitutes acceptance of the revised Terms.
Governing Law:
These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria.
Notice
We may give notice by means of a general notice on the Services, electronic mail to your email address in your Account, telephone or text message to any phone number provided in connection with your account, or by written communication or pre-paid post to any address connected with your Account. Such notice shall be deemed to have been given upon the expiration of forty-eight (48) hours after mailing or posting (if sent by courier) or twelve (12) hours after sending (if sent by email or telephone). You may give notice to Genius by Pettysave, with such notice deemed given when received by Genius by Pettysave, at any time by courier to our registered office address for service of process, or by email for general communication.
Severability
In the event any court or tribunal holds any portion of these Terms & Conditions to be invalid or unenforceable, either in whole or in part. In that case, that part shall be severed from the terms and conditions and shall not affect the validity or enforceability of any other part in these Terms & Conditions.
